Terms, Conditions and Return Policy

Waia Games, who help manage and maintain the official www.waiagames.com website (referred to as “We”, “Our” and “Us” in these terms) suggest that the customer (referred to as “You” and “Your” in these terms) should spend some time reading through these terms of trading. By entering a purchase transaction with Waia Games you automatically agree to our Terms and Conditions.
Our Terms and Conditions are liable for change at any time in which case you will be notified by email.
These terms of trade govern the sale and supply of goods by Waia Games to you. Waia Games may amend these terms from time to time. You shall be notified of any amendments by a notice on the Waia website.

Waia Games’s Contract With You
No contract shall exist between you and Waia Games until Waia Games has sent you an email confirming receipt and acceptance of your order. Waia Games is entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods or the order appearing on Waia Games’s site or for unavailability (see 3. below). Waia Games reserves the right to place restrictions on the volume of any goods ordered. By placing an order for products with age restrictions you declare that you are of legal age to purchase those products.

Pricing and Availability
The prices and availability of the goods are specified on the Waia Games site. Such information is subject to change without notice. There shall be an additional charge for delivery, the amount of which shall vary according to the delivery method that you choose. In the unlikely event that the goods are unavailable, or that Waia Games needs to vary the price due to supplier price increases, tax changes or site errors for example, following confirmation of your order Waia Games shall send you a notification by email and allow you the opportunity to cancel your order if Waia Games has not done so itself.

Cancellations prior to dispatch will be accepted on standard items. Cancellations will not be accepted once goods have been dispatched. For special order or non-standard items, cancellations will not be accepted.

Delivery is charged at cost based on the weight of the order. We continually review postage charges and alternative carriers to offer you the most competitive rate available. Goods should be ready to dispatch within 3 working days of the next delivery day (delivery days are monday and friday) after receipt of the order providing goods are in stock and available. This may take longer during busy periods such as release weeks, Christmas and Black Friday sales. Dispatch dates may vary depending on stock availability and public holidays. All deliveries will not require a signature unless specified at the point of order. Please note delivery dates cannot always be guaranteed and may be subject to circumstances out of the Waia Games control. Waia Games does not accept claims for loss due to late delivery. Web products may be supplied without outer boxes and in a ziplocked bag.

Duty and Tax
Please check with your local customs office for any customs charges and import taxes that may apply to your shipment before placing any orders as you will be responsible for paying these fees. If a shipment is refused and returned due to unpaid fees then we will not be able to refund your order or send it again.

Shortages or Damages
Goods must be inspected on delivery and all claims or shortages must be reported within 5 working days of receipt of delivery in order for any rectifications to be made.

Where goods have been ordered in error or are not received as expected Waia Games may agree to their return and a refund minus postage and packaging on the following conditions: Returns authorization must be requested within 48 hours of receipt of goods. The reference number received with this authorization must then be quoted on any accompanying documentation in relation to the returned goods. Goods must then be returned to the below address within 7 days from receipt of authorization. Goods must be returned unused, in perfect, saleable condition and in their original packaging. It is the responsibility of the buyer to arrange for the return carriage and to ensure that the goods are adequately packaged so as to avoid damage in transit. Waia Games accepts no responsibility for goods lost or damaged in transit to us. We strongly recommend that proof of purchase or dispatch is acquired by the buyer prior to return. For any goods returned as faulty, goods will be inspected before any refunds or replacements will be made. This does not affect your statutory rights.

Governing Law and Jurisdiction
Contracts between you and Waia Games shall be governed by Spanish Law and all disputes shall be submitted to the non-exclusive jurisdiction of the Spanish courts.

Invalidity of Terms and Conditions
If, for any reason, part of these terms and conditions is unenforceable, the validity of the remaining terms and conditions shall not be affected.
